Terms & Conditions
1. About Gangatu
Gangatu is a psychology and psychoeducation project owned and operated by Noemi Sanchez Lozar.
Website: www.gangatu.com
Contact: hello [at] gangatu [dot] com
Address: 28028 Madrid, Spain
Noemi Sanchez Lozar is a licensed psychologist registered with the Official College of Psychology of Madrid under membership number M-37408.
Her professional practice is subject to the applicable Spanish legislation and the Code of Ethics of the Spanish psychology profession.
2. Scope of these terms
These Terms & Conditions govern:
- access to and use of the Gangatu website;
- the purchase and use of Gangatu’s digital products; and
- the general commercial conditions applicable to psychological services offered through Gangatu.
By using this website or purchasing a product, you agree to these terms. Additional terms displayed on a sales page, at checkout or in a private service agreement also apply.
Detailed clinical conditions and informed consent documents are provided privately to people who are formally accepted as patients.
3. Eligibility
Gangatu’s website, products and services are intended exclusively for people aged 18 or over.
By purchasing a product or requesting a service, you confirm that you meet this requirement and have the legal capacity to enter into a contract.
4. Website and educational content
Gangatu publishes articles, newsletters and other psychoeducational material for general educational purposes.
Using the website, subscribing to the email list or purchasing an educational product does not create a psychologist–patient relationship. Such a relationship begins only when Gangatu formally accepts a person as a patient and the relevant private documentation has been completed.
Further information appears in the Disclaimers section of this Legal page.
5. Psychological services
Gangatu offers online individual psychological consultations and ongoing therapy, subject to availability and professional acceptance.
Submitting a request does not guarantee that a service will be offered. Gangatu may decline a request where the service is not clinically, professionally or legally appropriate.
International clients are responsible for checking whether they require a professional belonging to a particular local healthcare or insurance network.
Gangatu does not provide crisis or emergency services.
6. Bookings, cancellations and missed appointments
An appointment is confirmed only once full payment has been made.
Payments for cancelled appointments are non-refundable. A client may reschedule an appointment without losing the payment by making the change at least 24 hours before the scheduled time.
A missed appointment without sufficient justification is charged in full and cannot be rescheduled.
Where a genuine emergency has occurred, Gangatu may allow the appointment to be rescheduled. Whether the circumstances qualify as a genuine emergency will be assessed on a case-by-case basis, and supporting evidence may be requested where appropriate.
Sessions may not be recorded, photographed or otherwise reproduced without the prior express consent of both the psychologist and the client.
7. Digital products
The content, delivery method, access conditions and any product-specific requirements are described on the relevant sales page.
Unless stated otherwise:
- access is provided immediately after purchase;
- access is permanent; and
- the purchase grants the buyer a personal, limited and non-transferable licence.
The buyer may not share, resell, sublicense, transfer, reproduce or redistribute the product or any access credentials.
Withdrawal and refunds
Digital products are supplied with immediate access.
Where the buyer has a statutory right of withdrawal, access will begin only after the buyer expressly requests immediate supply and acknowledges that beginning delivery results in the loss of that withdrawal right.
Once access to the digital content has begun, purchases are final and non-refundable, except where a refund or other remedy is required by applicable law, or where the product is defective or materially different from its description.
Purchases processed through a third-party merchant or platform may also be subject to that platform’s applicable terms and refund procedures.
8. Prices, payments and invoices
Prices are displayed and charged in euros. Any amount shown in another currency is an approximate conversion only. The final amount charged may vary according to the exchange rate or fees applied by the buyer’s bank or payment provider.
Published prices include the applicable taxes and represent the final price unless expressly stated otherwise.
Payments may be processed through Stripe, Gumroad or another provider identified before purchase.
A receipt or invoice will be issued after payment by Gangatu or by the relevant merchant or payment platform, as applicable.
9. Electronic contracting
Purchases are completed by following the checkout instructions, reviewing the order information, accepting the applicable terms and confirming payment.
The buyer may review and correct the information entered before submitting the order.
Contracts are concluded in English. A confirmation is sent electronically after the transaction. Transaction records may be stored by Gangatu and/or the payment platform used for the purchase.
10. Intellectual property
Unless expressly stated otherwise, all articles, newsletters, digital products, written materials, branding and original content published by Gangatu belong to Noemi Sanchez Lozar and are protected by intellectual property law.
Content may be accessed for personal and non-commercial use only.
Without prior written permission, users may not:
- reproduce, republish or distribute Gangatu content;
- translate, modify or create derivative works;
- sell, license or commercially exploit it;
- systematically scrape, extract or archive it; or
- use it to train, develop or operate artificial intelligence or machine-learning systems.
Brief quotations may be used only where permitted by law and must include clear attribution to Noemi Sanchez Lozar or Gangatu and a link to the original source. Attribution alone does not authorise broader reproduction or reuse.
11. Affiliate links and external websites
Some Gangatu content contains affiliate links, including links associated with the Amazon Associates programme. Gangatu may receive a commission from qualifying purchases without increasing the price paid by the user.
The website may also link to external websites or services. Gangatu does not control their availability, content, privacy practices or terms and is not responsible for them.
12. Prohibited use
Users must not use the website, products or services:
- for unlawful, fraudulent or abusive purposes;
- to interfere with the website’s operation or security;
- to gain unauthorised access to restricted areas or systems;
- to distribute malicious code; or
- in any way that infringes Gangatu’s or another person’s rights.
Gangatu may restrict access where these terms are breached.
13. Availability and liability
Gangatu takes reasonable care to maintain the website and provide accurate information but does not guarantee that the website will always be available, uninterrupted or free from technical errors.
Gangatu may update, suspend or remove website content, products or services where reasonably necessary.
To the fullest extent permitted by law, Gangatu is not responsible for indirect or unforeseeable losses resulting from the use or inability to use the website or its general educational content.
Nothing in these terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
14. Privacy and cookies
Personal data is processed in accordance with Gangatu’s Privacy Policy.
The use of cookies and similar technologies is explained in the Cookie Policy. Non-essential cookies are subject to the user’s consent where required.
15. Changes to these terms
Gangatu may amend these Terms & Conditions to reflect changes in the website, its services or applicable law.
The version published on this page will apply from the date shown at the top. Changes will not apply retroactively to completed purchases unless required by law.
16. Governing law and disputes
These Terms & Conditions are governed by Spanish law.
Where the user is a consumer, this choice of law does not deprive them of any mandatory protections applicable under the law of their country of habitual residence.
Any dispute will be submitted to the courts or authorities competent under the applicable law. Before initiating formal proceedings, users may contact hello [at] gangatu [dot] com to seek a resolution.
